Welcome to Ocasia, an AI-powered room decoration and design application developed by Moduly.ai ("we," "us," or "our"). By downloading, accessing, or using the Ocasia mobile application (the "App"), you agree to be bound by these Terms of Use (the "Terms"). If you do not agree to these Terms, please do not use the App.
Ocasia is an artificial intelligence-powered mobile application that enables users to generate, customize, and visualize room decoration designs for various occasions, themes, and spaces. The App uses advanced AI technology to create personalized room design suggestions based on user inputs and preferences.
You must be at least 18 years of age to use the App independently. Users between the ages of 13 and 17 may use the App only with the consent and supervision of a parent or legal guardian who agrees to be bound by these Terms. By using the App, you represent and warrant that you meet these age requirements.
While the App may be used without registration, certain features may require account creation. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account.

We offer various subscription plans that provide access to premium features and credits. Subscription pricing and terms are displayed within the App and may vary by platform (iOS, Android) and region.
Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. You will be charged through your Apple App Store or Google Play Store account.
You may cancel your subscription at any time through your App Store or Google Play Store account settings. Cancellation takes effect at the end of the current billing period. No refunds will be provided for partial subscription periods.
If you are offered a free trial, you will be charged the subscription fee at the end of the trial period unless you cancel before the trial ends.
We reserve the right to modify subscription prices. Price changes will not affect your current subscription period but will apply to subsequent renewal periods. You will be notified of price changes in advance.
You may upload images, photos, or other content ("User Content") to the App. You retain all ownership rights to your User Content. By uploading User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, process, and store your User Content solely for the purpose of providing and improving the App's services.
You own the designs and images generated by the App based on your inputs ("Generated Content"). You may use, modify, share, and distribute Generated Content for personal and commercial purposes, subject to these Terms.

The App, including its design, features, algorithms, code, trademarks, and all other intellectual property, is owned by Moduly.ai and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, reverse engineer, or create derivative works based on the App.

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY. WE DO NOT WARRANT THAT:

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY, OR FIFTY DOLLARS ($50), WHICHEVER IS GREATER.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN WARRANTIES OR LIABILITY. IN SUCH JURISDICTIONS, OUR LIABILITY WILL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

These Terms are governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law principles. If you are a resident of the European Union, Switzerland, Norway, or Iceland, the laws of your country of residence may also apply.
Any disputes arising out of or related to these Terms or the App shall be resolved through good faith negotiations. If negotiations fail, disputes shall be subject to the exclusive jurisdiction of the courts located in California, United States.
You agree to comply with all applicable export and re-export control laws and regulations. You may not use or export the App in violation of U.S. export laws or to any country or individual subject to U.S. embargoes or sanctions.
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect. The invalid provision will be modified to the minimum extent necessary to make it valid and enforceable.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Moduly.ai regarding the App and supersede all prior agreements and understandings, whether written or oral.
Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision. No waiver shall be effective unless made in writing.
You may not assign or transfer these Terms or your rights under these Terms without our prior written consent. We may assign these Terms without restriction.
